Former U.S. Attorney Joe DiGenova says the lawyers involved in bringing an indictment against Texas Republican Gov. Rick Perry should be disbarred.
DiGenova, the former U.S. Attorney for the District of Columbia, made the comments on WMAL radio in Washington, D.C., Monday morning with Brian Wilson and me.
"Right now, this looks like a travesty of justice," DiGenova said of the indictment charges brought late Friday against Perry. "I expect the governor to file a motion to dismiss, perhaps even try to get an injunction before he is arraigned. This is an absolute disgrace."
DiGenova then explained how the DA's office involved in this case has a long and sordid history of politically motivated indictments. Not only did this office indict former House Majority Leader Tom Delay (R.) which launched a seven-year ordeal that eventually got all charges dropped against him, "this is the same office that indicted Kay Bailey Hutchison (R.) many, many years ago, just as she was becoming a U.S. senator." DiGenova explained, "the case was so bad that it was thrown out, the government itself refused to present the case and the case was thrown out. "
He then pointed out a pattern of abusive "lawfare" that Republicans need to "wake-up" to:
This is part of a pattern, Republicans better wake up they're a little stupefied these days ... do you notice a pattern? Criminal investigations of potential Republican presidential candidates. People had better get off their duff and start fighting back. And you know what? Rick Perry was the wrong guy to do this to because this guy is going to fight back and he is going to win. This is so disgraceful that the people involved in this indictment should be disbarred.
