The Supreme Court denied a motion on Monday to dismiss Sen. Bob Menendez's (D., N.J.) bribery charges. Menendez will be tried by a federal court in September.
An April 2015 indictment accused Menendez of accepting nearly $1 million in bribes. He petitioned the Supreme Court, arguing that an appeals court misinterpreted a constitutional provision barring the executive and judicial branches from "questioning a member of Congress about legislative activity," according to USA Today.
Menendez allegedly used his political office to help co-defendant and ophthalmologist Salomon Melgen after receiving campaign contributions from Melgen. Both men pleaded not guilty to charges which included bribery, honest services fraud, violations of the travel act, and conspiracy.
Menendez is accused of accepting bribery because of the timing of his actions, rather than from recordings or witnesses, USA Today reported.
