Sen. Marco Rubio (R., Fla.) filed an amicus brief Monday regarding Supreme Court case Town of Greece v. Galloway, a religious liberty case.
The case involves a New York town, which the New York-based U.S. Court of Appeals for the Second Circuit found in violation of the Constitution for allowing its town meetings to be opened with prayer. The town’s practice welcomed prayer of any religion as well as reflections from atheists.
The Supreme Court will take up the case in its upcoming term.
"This case brings about an historic moment in the effort to preserve the fundamental American principle of religious liberty," Rubio said. "The court of appeals' decision was flawed in its interpretation of the founders' intention for religious liberty. America was founded on the ideal that Americans have the right to practice or not practice any religion, not that public forums should be free from religious expression or limited to court-approved prayer.
The brief was also signed by several other senators.
