White House Won't Immediately Appeal Court Ruling on Travel Ban

The Trump administration will not immediately appeal the 9th Circuit Court of Appeals ruling that struck down its travel ban to seven Middle Eastern countries.

CNN reports that the administration has paused a potential appeal to the Supreme Court and is considering other options for pursuing its immigration policy goals. The administration may attempt to rework the immigration executive order so it is shielded from court challenges.

The news comes days after a three-judge panel denied the administration an emergency stay of the appeals court decision. If the stay had been granted, the immigration executive order would have been reinstated.

The state of Washington argued that the travel ban amounted to a religious test prohibited by the Constitution. The president and the Justice Department argued the ban was a constitutional use of executive power.

After the stay was denied, Trump tweeted, "SEE YOU IN COURT," leading many to believe the administration would soon file an appeal.
