Fox News reporter Catherine Herridge said Tuesday that Hillary Clinton’s emails were classified under an executive order signed by President Obama.
Clinton said that the Justice Department investigation into whether classified material was mishandled on her server is a disagreement between the State Department and intelligence agencies on the classification of information.
"What you're seeing now is a disagreement between agencies saying, you know what? They should have, and the other saying, no, they shouldn't," Clinton said. "That has nothing to do with me."
Herridge reported that an executive order signed by President Obama, gives authority to the intelligence agencies to declassify sensitive material and not Clinton or the State Department.
"Under this executive order, 13526, signed by Mr. Obama in December 2009, only the three intelligence agencies who own that information in the first place have the authority to declassify it, not Mrs. Clinton and not the State Department," Herridge said.
