Two Democratic Cleveland city councilmen will face a judge this month in the same week for drunk driving charges, Fox Cleveland reports.
One, Councilman Zack Reed, was arrested last month on his third OVI arrest (Operating a Vehicle (while under the) Influence), after failing a field sobriety test. Reed has served on the city council since 2000.
The second, Councilman Eugene Miller, was originally pulled over for speeding in November and arrested on OVI charges despite registering a blood-alcohol content below the legal limit, according to Fox Cleveland:
Miller, the Ward 10 councilman, was pulled over for speeding. He was arrested after the officer smelled alcohol, and he admitted to having a couple of drinks.
Miller’s citation also shows that his blood alcohol content was .056, which is actually below the legal limit of .08.
Cleveland police, however, said even if a driver is below the legal limit of .08, they can still be charged with drunk driving. For example, the alcohol combined with prescription medication could cause the person to be impaired and fail a field sobriety test.
