Federal Judge Temporarily Blocks Trump Efforts to End DACA Program

A federal judge ruled Tuesday that DACA participants are likely to succeed in their challenge to President Donald Trump's ending of the program, temporarily blocking the Trump administration from ending it.

This ruling by Judge Nicholas G. Garaufis of the U.S. District Court for the Eastern District Court of New York, combined with a ruling from a California judge in January, means the DACA (Deferred Action for Childhood Arrivals) program could end past its planned March 5 date, CNN reports.

The judge said the decision to end the program was based on the "plainly incorrect factual premise" that the program was illegal.

"The question before the court is thus not whether defendants could end the DACA program, but whether they offered legally adequate reasons for doing so," wrote Judge Garaufis, a Clinton appointee to the court, according to the Washington Times.

"Based on its review of the record before it, the court concludes that defendants have not done so," he said.

The Supreme Court is set to meet behind closed doors this week to decide whether to take up the Trump administration's appeal with the related California case.
