Biden Says Voters Don’t Deserve to Know His Position on Court Packing

October 11, 2020

Democratic presidential nominee Joe Biden said voters don't deserve to know if he would support Democratic efforts to add more seats to the Supreme Court.

Biden reiterated his refusal to state his position Friday when asked by reporters if "voters deserve to know" his stance on the issue.

"No, they don't," Biden replied.

Biden argued that it would help President Donald Trump if he stated a position on court packing while the Senate still considers Trump's nominee, Amy Coney Barrett. Biden and his running mate Kamala Harris have steadfastly refused to take a position on packing the Supreme Court, but Biden has never gone so far as to say voters do not deserve to know where he stands on the issue.

"I'm not going to play his game," Biden said. "[Trump would] love that to be the discussion instead of what he's doing now."

After one reporter said court packing is the top issue among his viewers, Biden said they are "probably Republicans" and called the whole issue a "distraction."

While Harris has assumed Biden's position and has not revealed where she stands on court packing, she said she was "absolutely open" to the idea during her ill-fated presidential campaign.
