White House Fact Checked on Talking with DOJ About Hillary Clinton's Emails

White House spokesman Josh Earnest seems to have a short memory when it comes to conversations had with the Department of Justice over indicting Hillary Clinton for her use of a personal server during her time as secretary of state.

On Wednesday, Fox News' Kevin Corke asked Earnest about Attorney General Loretta Lynch, who made a comment saying there had been no conversations between the Department of Justice and the White House. Corke asked if the White House could update the press if there had been any conversations including updates on the status of the investigation.

"Well, obviously I have not been a part of those conversations and the attorney general who leads that department says that they did not occur," Earnest said. "So I wouldn't have any reason to disagree with her or to think that she's not correct when she says the Department of Justice has not been communicating extensively with the White House about this."

Corke asked again if the White House has had any conversations with anyone and if there has been any guidance. Earnest simply said no.

But just a few months prior in January, Corke asked if the White House with certainty and confidence that Clinton would not be indicted.

"That will be a decision that is made by the Department of Justice and prosecutors over there," Earnest said. "What I know that some officials over there have said is that she is not a target of the investigation. So, that does not seem to be the direction that it is trending but I'm certainly not going to weigh in on a decision or in that process in any way. That is a decision to be made solely by independent prosecutors but again, based on what we know from the Department of Justice it does not seem to be headed in that direction."

The Associated Press has reported that the Obama administration has confirmed that Clinton's private server contained top-secret information and the State Department has censored 22 emails with that classification marking.
