Sen. Mike Johanns (R., Neb.) discussed the recent ruling that President Obama’s appointments to the National Labor Relations Board when the Senate was in session were unconstitutional Monday on CNBC.
“We’ll see if the White House responds in a positive way,” he said. “So far, their actions on this have been very brazen. It’s hard for me to imagine how they could make this appointment when we weren’t in recess. That’s the remarkable thing about this.”
Responding to a query about the New York Times editorial calling out the D.C. Circuit Court for siding with “Republican chicanery,” Johanns had a sharp reply.
“In all due respect to the New York Times, that just suggests that they read the Constitution,” Johanns said. “It’s pretty clear on this.”
