A Department of Justice trial attorney was arrested for having sex on a train and assaulting an officer, according to an agency watchdog.

The agency’s inspector general confirmed allegations from a Department of Justice division that the trial attorney "engaged in sex acts on a train, refused to disembark when asked by train and law enforcement officials, and became combative and kicked an officer while being removed from the train."

"The attorney was arrested and charged with disorderly conduct, resisting arrest, and assaulting a law enforcement officer," the inspector general said in a summary of its investigation made public Thursday.

The attorney received what amounts to three workweeks of community service.

"The attorney was charged by local authorities with disorderly conduct, resisting arrest, and assaulting a police officer, and entered into an agreement with local authorities requiring that the attorney complete 120 hours of community service as part of a pretrial diversion program," the inspector general said. "The OIG also found that the attorney lacked candor in an email to the employing division’s security personnel about the extent of the misconduct."

It is unclear whether or not the attorney is still employed with the Department of Justice. Request for comment was not immediately returned.

Department of Justice trial attorneys typically earn $139,234 per year.
